Farmers Insurance has agreed to pay $2.87 million to settle a class action lawsuit accusing a Texas insurance agent of sending unsolicited phone calls and text messages in violation of the federal Telephone Consumer Protection Act.
The class action lawsuit alleges that Todd Henderson Insurance Agency and/or R. Todd Henderson sent calls and messages to phone numbers registered with the National Do Not Call Registry. Todd Henderson Insurance Company is located in Northwest Dallas.
The alleged phone calls and text messages occurred from October 8, 2020, to March 13, 2026. About 8,000 people whose phone numbers are on the do-not-call list have received at least two text message ads from Henderson or a Henderson agency.
Farmers agreed to resolve all litigation surrounding the proactive information while denying any wrongdoing.
Class members must submit claims by July 24 to receive their prorated share of the settlement up to $425. A final approval hearing for the settlement agreement is scheduled for July 31.
